Father Of Man Fatally Struck By Metro Bus While Chasing Dog Sues Agency

LOS ANGELES (CBSLA.com) — The father of a 21-year-old man killed in August after he was struck by a Metro bus in North Hollywood while chasing his dog is suing the agency.

Walter Shelby, Jr. filed claims in Los Angeles Superior Court Thursday, claiming Metro was negligent in the death of his son, Xavier Shelby.

City News Service reports the young man was running after his pit bull puppy, who was chasing after a ball, when both were fatally struck by the bus traveling south on Webb Avenue the morning of August 14. They were pronounced dead at the scene.

Shelby claims the bus was operated in "an unsafe and negligent manner" and that its operator "failed to drive... at a speed which was reasonable and prudent..." the outlet reports.

Shelby is seeking compensation for burial expenses and unspecified damages.

A spokesperson for Metro has not commented on the case.
