Ruling Limits Access To Porn Actress' HIV Records
LOS ANGELES (AP) — Citing medical privacy, an Alameda County judge has denied state workplace safety officials access to medical files and personal information for a porn actress who contracted HIV in 2009.
The June 14 ruling says state laws that give health officials a right to the information in order to track outbreaks don't extend to the Division of Occupational Safety and Health, known as Cal/OSHA.
The case was brought by an actress who contracted HIV in Los Angeles County.
She was represented by the American Civil Liberties Union of Southern California. Legal director Peter Eliasberg says medical privacy rights don't change depending on what a person's occupation is.
A call to Cal/OSHA was not immediately returned Wednesday.
