KNX 1070′s Vytas Safronikas reports one official from the Department of Homeland Security had a stark warning for business owners.

“Take it seriously, make the investments,” said DHS cyber-security counselor Bruce McConnell. “I think the key thing is to look at cyber security and manage it just like you manage other risks, financial risks, reputation risks.”

McConnell was the featured speaker at the fourth annual Information Security Summit held at the Universal City Hilton, where the theme of “The Growing Cyber Threat: Protect Your Business” sought to instruct entrepreneurs and other information security professionals on the imporance of safeguarding sensitive content posted online.

In addition to financial fraud, McConnell also warned of the risks of copyright theft, especially for media firms.

“We’re losing a lot of intellectual property from cyber theft, and I think that’s very worrisome from the long-term competitiveness of the U.S.” he said. “It’s very serious.”

McConnell, who was joined by Alan Paller, director of research at the SANS Institute, at the conference held by the Los Angeles chapter of the Information Systems Security Association, also noted that the vast majority of companies are largely unwilling to admit when their systems have been compromised.

“We say there’s two kinds of companies: those that have been hacked, and those that don’t know they’ve been hacked,” said McConnell.

Gregory Yusuke Shiga, 34, was arrested Monday by detectives from the Los Angeles County Sheriff’s Department’s arson/explosives detail. Shiga was arrested at his Los Angeles home and charged with arson in the April 16, 2011 fire that destroyed the sanctuary of St. John Vianney Church, causing $6.5 million in damage.

Firefighters battled the blaze at the church, 1345 Turnbull Canyon Road, for about two and a half hours. Investigators later determined that the fire had been intentionally set.

Shiga is on parole and is being held without bail. He is due to be arraigned Wednesday afternoon. Prosecutors are asking that his bail be set at $1 million.

Charges against Shiga include arson, possession of flammable material and burglary. If convicted, Shiga faces up to 12 years to life in prison.

The family of Adilia Rodriguez says she left specific wishes: a closed casket funeral and internment aboveground in her hometown in Nicaragua. Instead, Rodriguez was placed in an open casket, dressed in another woman’s clothing and buried in that woman’s cemetery plot, the Los Angeles Times reported.

The Rodriguez family’s lawsuit against Rose Hills Memorial Park and Mortuary claims the funeral home confused her with another woman and is seeking pain and suffering and punitive damages.

Rodriguez, who was 87, had made her wishes known years before her death, even before her health declined, according to the Times.

The funeral home has refunded the family for the funeral insurance they purchased after the incident.

Rodriguez’s body has since been exhumed and interred in Nicaragua, the Times reported.

HUNTINGTON PARK (CBS) — Police said a male kidnapping victim has been found safe after a sheriff’s SWAT team was deployed to a Huntington Park neighborhood on Wednesday.

The victim was transported to Saint Francis Hospital to be treated for minor injuries, authorities said.

Three suspects are also reportedly in custody, but none of them were arrested in Huntington Park. The location where they were taken into custody is still undisclosed.

The investigation was conducted in the 6100 block of Rugby Avenue after authorities got a search warrant for the apartment building after receiving information from the arrests.

SKY9′s Heather Lawrence reports Randolph Street was closed between Pacific Boulevard and Malabar Street during the investigation as authorities told residents to stay indoors until the area is clear.

LOS ANGELES (CBS) — A case of puppy love has turned into a contentious legal battle between a New York tattoo artist and his ex-girlfriend, who allegedly took the man’s dog to Los Angeles.

A judge ruled Wednesday that “Knuckles” the Puggle should stay in San Pedro for now.

“I’m not worried. I’m just here to protect my dog. I was never in New York when he made that order and they don’t have jurisdiction over me,” said owner Sarah Brega.

“Knuckles was kidnapped by my ex-girlfriend and the legal fees to retrieve him are going to bankrupt me,” says 34-year-old Craig Dershowitz.

In a New York Supreme Court filing, Dershowitz claims ex-girlfriend Sarah Brega wrongfully took Knuckles, after the couple ended their relationship — a claim Brega denies.

Dershowitz claims the bi-coastal custody battle has cost him as much as $60,000, and he’s asking the public to help fund his legal efforts.

“I had to hire two private investigators to find [his ex-girlfriend],” Dershowitz says in a video posted online.

Dershowitz is selling t-shirts, puppy kisses, and even a professional portrait inspired by Knuckles to reach his $20,000 fundraising goal.

As of Tuesday, donors had pledged nearly $3,704 with just a month left before Dershowitz’s self-imposed deadline.

According to Dershowitz, a judge has already ruled that Knuckles should be in his custody. A Los Angeles based judge said Wednesday that he wanted to wait and see how the custody case plays out in New York.

“She absolutely frustrated to have to go through this. This is a gentleman that she had a relationship with, broke up with over a year ago. He left the dog with her when he moved out and now all of the sudden when she decides she is going to move to California and he can’t get in contact with her, he decides he wants the dog,” said Brega’s attorney Robert Splinter.

Despite an uphill battle that has cost him his life savings, Dershowitz vows to see the campaign through to the end.

“All I want is to bring Knuckles back home to me,” he said. “He really is my son.”

The LA-based judge will revisit the case on June 19.

Suleman’s bankruptcy case was tossed out of court after she reportedly failed fill out all of the necessary paperwork. If completed, the proceedings would have halted the foreclosure and auction of her home.

Suleman and her 14 children could be forced to move from the home very soon.

Last month, authorities declined to take any action after her hair stylist complained about possible health violations at the home.

The median price for new and existing homes and condominiums in the six-county region climbed to $290,000, up 3.6 percent from the same period last year, DataQuick said.

It was the first annual increase in 16 months and matched the highest price since December 2010.

There were 19,284 homes sold, up 5.1 percent from a year earlier.

DataQuick said there were fewer sales of foreclosed properties, which tend to go for lower prices. Higher-priced coastal markets also showed signs of improvement.

“The housing market continued its painfully slow crawl back toward normalcy last month,” DataQuick President John Walsh said.

Properties that were foreclosed upon in the previous year made up 28.6 percent of existing-home sales in April, down from 33.8 percent in the year-ago period and the lowest since January 2008. In February 2009, foreclosed properties accounted for 56.7 percent of existing-home sales.

Short sales — in which the price was less than the amount the seller owed on the mortgage — accounted for 18.4 percent of existing-home sales last month, up from 17.3 percent a year earlier.

Sales of homes between $300,000 and $800,000 rose 3.5 percent in April from the same period last year. while sales for less than $200,000 fell 4.7 percent last month.

The four coastal counties — Los Angeles, Orange, San Diego and Ventura — accounted for 71.5 percent of sales last month, up 68 percent from April 2011. The two inland counties — Riverside and San Bernardino — had been driving much of the gradual rebound.

Ebanks has been fined $25,000 for actions prior to and following his ejection from the Lakers’ 119-90 loss to the Oklahoma City Thunder in Game 1 of the Western Conference Semifinals on May 14.

Bynum has been fined $15,000 for failing to make himself available to the media following the Lakers’ practice on May 15.

Lonnie Remmers, 54, of Corona, is the pastor of the Heart of Worship Community Church, which operates the men’s group home. Remmers, along with Nicholas Craig, 22, and Darryll Jeter, 28, were arrested on suspicion of kidnapping, torture, and child abuse, Corona police said.

The boy, 13, was taken to the home on March 18 by a Corona mother who was seeking guidance for her son.

While at the group home, police say the boy was driven into the desert in Barstow by Craig and Jeter, who both live at the home on West Tenth Street. Under Remmers’ direction, Jeter and Craig were instructed to “scare” the boy and forced the boy to dig a grave and threatened to kill him, police said.

Jeter and Craig also allegedly threw dirt on the boy, hit him with a belt and rubbed salt in his wounds as the boy showered after the desert trip, according to the Riverside Press-Enterprise.

Later that day, detectives discovered the boy was taken to Remmers’ home in Corona for Bible study. During the Bible study, Remmers allegedly assaulted the boy, police said. A circle of about 12 men watched as Remmers used pliers to squeeze one of the boy’s nipples, the Press-Enterprise reported.

All three men were freed last month after posting $1 million bail each.

The lucky ticket was sold at the Mobil station at 10857 Santa Monica Blvd., according to a California Lottery official.

Eight tickets with five numbers, each missing the Mega number, were sold in Georgia, Louisiana, New York, Ohio, Oklahoma, Pennsylvania, South Carolina and Virginia. Those tickets are each worth $250,000.

However, the big winner will either get $18.6 million in cash or receive 26 annual payments of approximately $961,000 each.

The odds of matching all five numbers and the Mega number are 1 in 175,711,536, according to the Mega Millions website.

The jackpot for Friday’s draw will be $12 million.

The chair of the U.S. Senate’s environment committee pressed federal regulators Tuesday to disclose details about the design of the plant’s troubled steam generators, in which hundreds of tubes that carry radioactive water have been damaged by unexpected vibration and friction.

Meanwhile, operator Southern California Edison said it was working toward meeting federal benchmarks that could open the way for a restart of at least one of the reactors, perhaps in time to meet summer power demand.

The twin reactors, located along the coast between San Diego and Los Angeles, have been shut down for more than three months while investigators try to determine the cause of the unusual tube wear.

On Tuesday, Sen. Barbara Boxer asked Nuclear Regulatory Commission Chairman Gregory Jaczko for documentation on how the federal agency reviewed a series of modifications to the generators, which might be the culprit in the mechanical trouble. Boxer, who chairs the Environment and Public Works Committee, sent a similar letter to SCE parent Edison International.

At issue is whether Edison sidestepped any federal requirements by conducting extensive design changes, a claim leveled by an environmental group that said the alterations are at the heart of the plant’s problems.

“Concerns have been raised that design changes in the steam generators contributed to accelerated wear in tubes carrying radioactive water,” wrote Boxer, D-Calif. “The determination to restart the San Onofre reactors must ensure the safety of the millions of Californians who live and work near the plant.”

A 13-page report issued by Friends of the Earth, a group critical of the nuclear industry, warned that running the plant at reduced power would not resolve problems with badly worn tubing.

Earlier this month Edison announced a tentative plan to restart and run the seaside reactors at lower power, at least for several months, because engineers believe that will ease vibration that could be eroding tubes.

The four generators at San Onofre each have nearly 10,000 alloy tubes that carry radioactive water.

The generators function something like a car radiator, which controls heat in a vehicle’s engine. The generator tubes circulate hot, radioactive water from the reactors, which heats a bath of non-radioactive water surrounding them. That makes steam, which is used to turn turbines to make electricity.

The tubes represent a critical safety barrier — if a tube breaks, there is the potential that radioactivity can escape into the atmosphere.

The Friends of the Earth report also expanded an earlier allegation that Edison misled federal regulators about the modifications, a claim disputed by the Nuclear Regulatory Commission and the company.

The trouble began to unfold in January, when the Unit 3 reactor was shut down as a precaution after a tube break. Traces of radiation escaped at the time, but officials said there was no danger to workers or neighbors. Unit 2 had been taken offline earlier that month for maintenance, but investigators later found unexpected wear on hundreds of tubes in both units.

The NRC has said there is no timetable to restart the reactors, which were replaced in 2009 and 2010 in a $670 million overhaul.

The report, written by Vermont-based nuclear consultants Fairewinds Associates, suggested the best alternatives might be scrapping and replacing the costly equipment, or spending as much as $400 million on repairs.

“Power reductions do not solve underlying and serious degradation problems,” the report said, warning that running at reduced power could spread the damage and result in tube fractures.

Gradual wear is common in such tubing, but the rate of erosion at San Onofre alarmed officials since the equipment is relatively new. The company last week said more than 1,300 tubes will be taken out of service, a far higher number than previously disclosed, but that number is well within the margin to allow the generators to keep operating.

The generators were designed specifically to meet a federal test to qualify as “in-kind,” or essentially identical, replacements, which allowed them to be installed without prior approval from federal regulators.

The report said a string of complex modifications involving tubes and supports should have triggered a more extensive review by the government, including public hearings, but did not.

In a statement, NRC spokesman Victor Dricks said the company informed the agency of the steam generator design changes “in accordance with NRC requirements,” and that portions of the design were reviewed by federal inspectors during the installation. He added that a team of investigators is reviewing those changes as part of its probe into tube wear at the plant.

The agency announced Tuesday it was conducting a routine review of “in-kind” repairs at the plant over the prior three years, which are common in the industry. The review was not prompted by the problems with the generators.

State officials have warned of possible power shortages in the region this summer while the plant remains dark.

Edison said in a statement that “the health and safety of the public and employees is the number one priority for San Onofre.”

Pacquiao was scheduled for an interview on Wednesday afternoon with Mario Lopez of TV’s “Extra” at The Grove in Los Angeles, but that appearance may be in jeopardy after comments he made to in response to President Obama’s endorsement of same-sex marriage last week.

The Philippine lawmaker told the National Conservative Examiner that he believes the Bible is very clear on the issue of homosexuality and that the President’s comments are in direct contradiction to Scripture.

“God’s words first,” Pacquiao told the Examiner. “Obey God’s law first before considering the laws of man.”

Granville Ampong, the writer of the article — but not Pacquiao himself — went on to quote a passage from the Old Testament book of Leviticus, which states that “If a man lies with a man as one lies with a woman, both of them have done what is detestable. They must be put to death; their blood will be on their own heads.”

That interview prompted a statement from Grove VP of corporate affairs Bill Reich which read, “Based on news reports of statements made by Mr. Pacquiao we have made it be known that he is not welcome at The Grove and will not be interviewed here now or in the future.

“The Grove is a gathering place for all Angelenos and not a place for intolerance,” the statement concluded.

But now Pacquiao said his statements were taken out of context and that he never stated that anyone in the gay community “deserved death”.

“I didn’t say that, that’s a lie…I didn’t know that quote from Leviticus because I haven’t read the Book of Leviticus yet,” he said.

However, Pacquiao did affirm that he remains opposed to the “marriage of anyone that is not Man and Woman as he believes is stated in the Bible.”

As of late Wednesday morning, neither Pacquiao or Lopez had updated their Twitter accounts to reflect any cancellation.

LOS ANGELES (CBS) — A Ferrari and a Lamborghini stored at an exotic car shop was damaged early Wednesday morning in a hit-and-run crash.

A livery service vehicle, perhaps a car being used as a taxi, slammed into Specialty Car Craft, 1862 South La Cienega Blvd., at about 3:30 a.m. The force of the crash was so powerful, the airbags deployed.

Police say the driver pulled the passenger, a 33-year-old woman, out of the car and left her bleeding from the head on the sidewalk near the crash before he ran off. The driver is still at large.

The woman sustained a broken pelvis, broken jaw, broken right leg and complained of pain throughout her body, but she is in stable condition, according to Los Angeles police.

The crash damaged a yellow Ferrari and a red Lamborghini parked just inside the door of the shop. There’s no word on how much damage was caused to the exotic cars.

The driver of the car is described as a white man, about 35 years old. Anyone with information about the accident or the driver’s identity can call Detective Arain at (213) 473-0234.

MANHATTAN BEACH (CBS) — Shoemaker Skechers USA agreed to pay $40 million to settle a Federal Trade Commission lawsuit over claims made by the company regarding toning footwear.

The consumer lawsuit claimed “toning” footwear known as Shape-ups, Tone-ups, Skechers Resistance Runner, and Shape-ups Toners toning shoes were falsely advertised to improve posture, promote weight loss, strengthen the back, improve blood circulation, promote sleep, reduce stress, reduce physical stress on knees, legs and ankle joints and burn calories.

“Skechers’ unfounded claims went beyond stronger and more toned muscles. The company even made claims about weight loss and cardiovascular health,” said David Vladeck, head of the FTC’s Bureau of Consumer Protection.

The Skechers ads challenged by the FTC included shape-ups ads featuring celebrities, including Kim Kardashian and Brooke Burke. The Kardashian ad showed her dumping her personal trainer for a pair of Shape-ups. While, the Burke ad told consumers that the newest way to burn calories and tone and strengthen muscles was to tie their Shape-ups shoe laces.

If approved by the court, the proposed settlement will result in cash refunds for each pair of shoes purchased in the following amounts:

- Shape-ups: $40-$80
- Podded Sole Shoes: $27-$54
- Tone-ups, Non-podded Sole: $20-$40
- Resistance Runner: $42-$84

LONG BEACH (CBS) — CBS2 is getting a sneak peak of the new penguin exhibit at the Aquarium of the Pacific in Long Beach.

The $1.5 million June Keyes Penguin Habitat will feature Magellanic penguins, some of which were rescued from Brazil where they were stranded outside their native habitat.

The penguins will join the Aquarium’s collection of more than 11,000 animals in the institution’s fifty exhibits.

The permanent exhibit opens to the public Thursday, May 17, at 9 a.m.

SAN DIEGO (CBS) — A third suspect has been arraigned in the investigation into the murder of a Marine wife whose body was found dumped in Riverside County.

KNX 1070′s Tom Reopelle reports Dorothy Grace Marie Maraglino has pleaded not guilty to charges of aiding and abetting in the murder of Brittany Kilgore.

Prosecutor Patrick Espinoza said Maraglino, 36, persuaded Kilgore to join Staff Sergeant Louis Ray Perez on a dinner cruise on April.

Shortly after she was picked up by Perez, Espinoza said Kilgore realized she was in trouble.

“Brittany sent a text message in distress asking for help shortly after the point in time when Mr. Perez was with her,” said Espinoza.

Perez, 45, was the last person to see Kilgore alive before the night of her disappearance on April 13. He pleaded not guilty last month to murder charges and remains in custody.

Prosecutors believe Kilgore was murdered by Perez and another suspect, Jessica Lopez, at Maraglino’s home in Fallbrook. Her body was found on April 17 near Lake Skinner in Riverside County.

Kilgore had reportedly filed for divorce from her husband, a Marine serving in Afghanistan, just three days before her disappearance.

Maraglino is being held along with Perez and Lopez on $3 million bail.

Stahl’s wife reported him missing on Monday, claiming that she had not seen the 32-year-old actor since last Wednesday, Richard French of the Los Angeles Police Department’s Media Relations office said.

KNX 1070′s John Brooks reports authorities said no foul play was suspected in the actor’s disappearance.

According to TMZ, Stahl’s wife filed court papers in February, expressing concerns that the actor may be using drugs. He was reportedly seen recently along the Skid Row section of downtown Los Angeles.

Stahl’s representative declined to comment on the situation.

STUDIO CITY (CBS) — If your morning commute takes you anywhere near Coldwater Canyon south of Ventura Boulevard in Studio City, you may want to start searching for an alternate route.

KNX 1070’s Pete Demetriou reports the drive between the San Fernando Valley and Beverly Hills is about to get very ugly for the next 10 months.

Starting today, crews will begin installation of a major water line that replaces the 98-year-old line that ruptured back in 2009 and caused significant flooding.

The work will take place primarily between Halkirk Street and Avenida Del Sol between 9 a.m. and 3:30 p.m. on weekdays — and at various hours on Saturdays — which will reduce Coldwater Canyon to one lane of traffic.

Flag crews will be on hand to direct traffic through the area.

The closure was unwelcome news to members of a landscaping crew that frequently drives the canyon.

“This is one of the main arteries we use other than the 405, and now we’re screwed I guess,” said one worker.

Studio City in particular has been plagued by recent water main breaks, including one rupture last November that left the busy intersection of Ventura Boulevard near Whitsett Avenue completely shut down for repairs.

David West scored 16 points and grabbed 10 rebounds, George Hill added 15 and the Indiana Pacers took home-court advantage away from Miami by beating the Heat 78-75 in Game 2 of the teams’ Eastern Conference semifinal series Tuesday night.

LeBron James scored 28 points for Miami and Dwyane Wade finished with 24, but both missed big chances for the Heat late. James missed two free throws with 54.3 seconds left and Miami down one, and Wade was short on a layup that would have tied the game with 16 seconds remaining.

Mario Chalmers’ 3-pointer to tie bounced away on the final play, and the series was tied 1-1.

Danny Granger scored 11 points and Paul George added 10 for Indiana, which took advantage of Heat forward Chris Bosh’s absence and outrebounded Miami 50-40.

Game 3 is Thursday in Indianapolis.

James had a chance to give Miami the lead with 1:22 left, but his shot was blocked from behind by George, who was fouled two seconds later. He missed both free throws, keeping the Indiana lead at 76-75. And after Wade missed a jumper, James was fouled by Granger — his sixth — battling for the rebound with 54.3 seconds remaining.

James couldn’t connect on either, and the Heat didn’t score again.

Bosh is expected to miss the rest of the series with a strained abdominal muscle. Without him, James and Wade combined for 52 points — and no other Miami player scored more than five.

A dreadful third quarter by Miami — 3 for 17 shooting — allowed Indiana to lead by as much as 11, before the emotions picked up considerably in the fourth.

Wade was steaming when he missed a shot after trying to create contact with Indiana’s Dahntay Jones with 9:53 left. As Wade argued, Jones went the other way and set Leandro Barbosa up for a score that put the Pacers up 63-56.

Chalmers turned the ball over on the next possession, and as the Pacers took off for what set up as a 2-on-none break, Wade caught Darren Collison from behind and knocked him over. A flagrant-1 was called, Collison hit both free throws, the Indiana lead was nine and tensions were suddenly high.

It all seemed to spark Miami.

The Heat scored the next six points, James — who got hit in the head by Granger with 7:25 left, sparking a bit of shoving that led to double-technicals given to both players — added a putback off an offensive rebound and Wade did the same about a minute later, getting Miami within 69-66 with 5:57 left.

James missed a free throw that would have tied it with 4:30 remaining, but after George got the rebound, James dove in to create a jump ball situation. The MVP easily won the tap, sending it to Wade, whose bank shot over West put Miami back on top 72-71.

Barbosa scored on the next Indiana possession. The Pacers weren’t rattled, and left celebrating minutes later.

Indiana scored 16 points in the first seven minutes of the first half, then scored 17 in the next 17 minutes. And even after a drought like that, Miami’s lead was only 38-33 at the break.

George missed four shots in a 60-second span early on, setting the tone for an icy-cold half by the Pacers. Indiana was up 16-9 midway through the first when the Heat went to a smaller lineup that paid quick dividends.

Three baskets at the rim — a layup by Wade, then James firing a pass to Turiaf for a dunk, followed by a Wade touch pass to James for another slam — erased most of the early deficit, and defense did the rest. Indiana missed 24 of 29 shots in one stretch, and after Hibbert used his size advantage to get three shots in the first 1:11, he only got two attempts over the rest of the half.

Miami was 0-for-7 on shots that would have pushed its margin to double digits in the first half, continuing a trend from Game 1. Neither team ever led the series opener by more than nine either, and when George made a 3-pointer with 6:09 left in the third, the Pacers had pulled into a 46-all tie. A steal and dunk by George followed on the next possession, putting the Pacers back on top.

Before long, the Pacers had that first 10-point edge of the series. Collison’s jumper with 1:29 left in the third put Indiana up 59-49, and the margin was 61-52 entering the fourth.

For as bad as Indiana’s first half was offensively, Miami’s third quarter was equally dreadful — the Heat were outscored 28-14 on 3-for-17 shooting in the period, the third-worst shooting effort by the reigning East champs in any quarter this season.

CBS will finish the season as America’s most-watched network for the ninth time in the past 10 years, leading in viewers by the widest margin of any network in 23 years.

The ridge of high pressure in the Pacific has nudged over slightly to bring us the northerly winds and warmer air mass.

TEMECULA (CBS) — A CBS2 News investigation has examined accusations that money pouring into Indian gaming casinos is bringing trouble to Southland reservations.

Two local tribes have been banishing members, stripping them of healthcare, education and monthly stipends. The tribes argue that it comes down to bloodlines, but those kicked out insist that it is really about money.

For more than a century, generations of distant cousins Rick Cuevas and Michael Madariaga’s families have walked the same dirt roads on the Pechanga Reservation in Temecula.

“We have the original deed signed by President McKinley,” Madariaga said.

Miles away at the Pala Reservation in Northern San Diego County, Gina Howard and her family have similar roots.

“My mother, Teresa Denver, we were both born in that house,” Howard said.

Although the two families have never met, they share a common story — members of both clans find themselves without a tribe.

“You’re whole community turns away from you. And they look at your like you’re a pariah,” Howard said.

“Nobody has more of a right or is more Pechanga than us,” Cuevas said.

It is called disenrollment. In both cases their tribal councils have questioned their bloodlines.

But the families believe that this is not about ancestry, it’s about settling old scores and about money.

“It’s about greed. I think it’s about control,” Howard said.

“It’s about money and political power,” Madariaga said.

Ever since the tribes got casinos, members have been entitled to a share of the windfall. Indian gaming is estimated to be a multi-billion dollar industry in California.

In July when Howard and seven of her relatives were disenrolled, she says that her cut of the Pala profits equaled about $9,000 a month.

At Pechanga W2 forms show that in 2005 members received $269,175.25 – more than $22,431 per month.

After Cuevas and his clan were kicked out in 2006, he says that number jumped to $30,000.

“Each person that has been disenrolled now, 250 of us, has lost $1.6 million, our rights to vote, our rights to healthcare, educational system. They threw a couple of our little cousins out of the tribal school, physically removed them from the school and told them that they could no longer be here again,” Cuevas said.

In documents obtained by CBS2 News , an anthropologist hired by Pechanga itself to study ancestry said that there is significant evidence that Cuevas and his clan are Pechanga.

The anthropologist is quoted in the documents saying that he is “surprised and dismayed that the tribe continues to maintain otherwise.”

Pechanga refused repeated requests for an on-camera interview. But in a statement, the tribe’s chairman, Mark Macarro said that it was a question of ancestry.

“Though deeply painful for our tribe and the people affected, this correction was necessary to protect the integrity of the tribal government, our culture and our history,” Macarro went on to say.

Pala chairman, Robert Smith, did sit down with us. He said the issue boils down to lineage, not money.

“It has nothing to do with money. They can say what they want, but that is not true. Right is right, wrong is wrong and they don’t meet the requirements to be enrolled in here,” Smith said.

He insisted that he had documents and records, that he would not show us, proving that Howard’s great-great grandmother was only half Native American.

That would mean Howard and her cousins do not meet the blood requirement to enroll as members of the Pala Tribe.

We asked Smith why he would not show us the documents.

“Again, we’re a sovereign Indian Tribe, we shouldn’t have to show you,” Smith said.

But the Bureau of Indian Affairs disagrees. In a letter obtained by CBS2, the BIA recommends that Howard and seven relatives be put back on the membership rolls, saying that they meet the required degree of Indian blood.

“We’ve got a document from them that says that she’s half, so they talk about of both sides of their mouth, the BIA. At the end of the day, under the tribe’s constitution, it’s the tribal council that determines membership,” Smith said.

A few months ago Pala disenrolled about another 150 of Howard’s extended family. They accounted for about 15 percent of the tribe’s membership.

“It’s pretty clear that there are tribal members, who should be in the tribe who are being disenrolled,” said Matthew Fletcher, an indigenous law professor at Michigan State University.

Fletcher has been studying mass disenrollments and says that he has noticed a pattern.

“We’re mostly seeing mass disenrollments in California and some of the other tribes around the country that have very successful gaming enterprises,” Fletcher said.

For now the disenrolled have no legal recourse, because Indian reservations are sovereign. State and federal judges have ruled the courts have no jurisdiction and the BIA has said that it has no authority over membership decisions.

“It’s going to take an act of congress,” said John Gomez Jr., president of the American Indian Rights and Resources Organization, who is a disenrollee.

Gomez says that congress must amend the Indian Civil Rights Act to allow courts to hear the cases.

“There is no available recourse and those tribal officials understand that. Their attorneys understand that. So they can manipulate the process,” Gomez said.

Everyone agrees that that will not be easy. Casinos pour money into campaign coffers and other tribes may not want the federal government meddling in tribal affairs.

In the meantime, Cuevas, Madariaga, Howard and others are left with memories and nowhere to turn.

“Now we can’t be buried here next to our relatives,” Cuevas said.

“They just threw us away like yesterday’s trash,” Howard said.

“They have the Rolexes, but we have the time,” Cuevas added.

Although disenrollments are taking place up and down the state, we want to be clear that locally it is specific to Pechanga and Pala.

Other Indian gaming casinos in Southern California, such as Morongo and San Manuel are not presently embroiled in similar disputes.

NORTHRIDGE (CBS) — California State University, Northridge has hired Diane Harrison as its new president amidst faculty and student protests and enrollment freezes.

Along with the cost of bringing in a new president, more new expenses will be required.

Potential costs include office renovations, salaries for new staff, moving costs, and welcoming events.

Office renovations are costing state funding $243,292 and renovations to the university house will cost around $115,000.

Housing renovations come from the University Corporation, who owns the house.

20-year CSUN faculty member, professor Nate Thomas, believes the renovations are unnecessary and too costly.

“This is a time of tight budgets. This is a time of cutbacks. This is a time of faculty furloughed. This is a time of students being locked out of classes. It just sends the wrong message,” he said.

Some CSUN students say the school should be spending the money on education, not renovation..

“I can only wonder. Maybe if there weren’t so many renovations, that could go into some scholarships and funds to help people like me who can’t get financial aid,” CSUN freshman Dana Schwartz said.

But interim CSUN president Harry Hellenbrand says he cannot spend the money on students because Cal State rules do not allow him to do that.

“If there was a choice between adding classes and refurbishing the offices the way that we did, clearly we would opt to choose to add the classes, but that’s not the choice that we’re faced with right now. The choice we’re faced with is either making these renovations now or postponing them further, but we’re not able to add more classes at this stage. I know that’s strange, but that’s politics in California,” he said.

He says an increase in enrollment would be the school over it’s quota, which is not permitted by the Cal State University system.

MONROVIA (CBS) — Anthony Orban served five years in the Marine Corps and fought in Iraq before working as a member of the Westminster police department for another five years.

But his career in law enforcement ended after he was arrested on charges of kidnapping and raping a woman in 2010.

“I knew exactly what it was. It was the medication,” Orban told KCAL9 News.

His wife, Tracy, said Orban was taking the drug Zoloft to deal with post-traumatic stress disorder associated with his time in combat and triggered by police work.

“He had invisible wounds that none of us saw. But he’s a casualty of war,” Tracy said.

Orban’s attorney is presenting a defense of “not guilty by reason of unconsciousness,” claiming the Zoloft made him do it.

“It doesn’t mean you’re unconscious, falling on the ground, asleep. What it means is that you’re not aware of your actions,” defense attorney James Blatt said.

CBS2 spoke with Dr. Joseph Haraszti, who is a forensic psychiatrist and a psycho-pharmacologist. He said an anti-depressant can’t make you perform complex behaviors such as kidnapping and rape and not realize it.

“To me, this seems like as a defense is a cop out. There is no such case where a person would become unconscious and not know what they’re doing while taking Zoloft,” Haraszti said.

Originally, Orban’s attorney was expected to present an insanity plea.

But changing the defense to “not guilty by reason of unconsciousness” could allow Orban to walk out as a free man.

Tracy said he won’t truly be free.

“He’s even said, ‘How do I live with that? I served my country. I served my community. How do I live with that? I protected people.’ So, no, that’s something he’ll carry the rest of his life,” his wife said.

LANCASTER (CBS) — A fire broke out at a Wendy’s in Lancaster, engulfing the entire restaurant until firefighters could get it under control Tuesday night.

Emergency dispatchers received a call at 4:47 p.m. after the fire ignited at 45101 10th Street West in Lancaster.

One firefighter was slightly injured while trying to put out the blaze and he was taken to a hospital.

Officials reported that a gas tank explosion caused the fire.

Firefighters were dumping a significant amount of water on the fire, as plumes of smoke rose above the spot in Lancaster. The structure appeared to be gutted by the flames.

LOS ANGELES (CBS) — A retired LAPD homicide detective has been arrested in the fatal beating of his wife in Hawaii six years ago after being long suspected of the crime, police officials said Tuesday.

Dan DeJarnette, 59, was taken into custody without incident Monday night at his home on the Big Island in connection with the slaying of his wife, Yu DeJarnette.

He said at the time of her November 2006 death that he had awakened and found her lying on a lava embankment about 20 feet from the couple’s home in Ka’u on the southern end of island. She suffered severe head trauma and was later pronounced dead at a hospital.

DeJarnette told patrol officers his 56-year-old wife had been hurt in an accident. But an autopsy determined she died from head trauma, and the retired officer was booked on suspicion of murder – and then released because of lack of evidence.

But authorities took a new look at the case in January. After additional investigation that included testing of DNA evidence, prosecutors secured an indictment against DeJarnette from a Hawaii grand jury, according to sources familiar with the case.

Chau Ngo was stunned to learn his old neighbor and friend, DeJarnette, is accused of killing his longtime wife.

“He’s very nice, he’s a cop. Everyday I saw him walk to the bus to go to work,” he said.

Ngo said he would allow his daughter to spend the night at DeJarnette’s home for sleepovers with their daughter.

DeJarnette was scheduled to make his first appearance Tuesday in a Hawaiian courtroom. He was being held in lieu of $200,000 bail.

The indictment comes just days after former LAPD Det. Stephanie Lazarus was sentenced to 27 years to life in prison with the possibility of parole for killing her ex-boyfriend’s wife nearly three decades ago in a fit of rage and jealousy.

LAPD Lt. Andy Neiman had no immediate comment on the DeJarnette case because he said DeJarnette is retired and the LAPD is not handling the criminal investigation.

After joining the LAPD in 1982, DeJarnette worked as a homicide detective at the Van Nuys Division and investigated rape cases while assigned to the department’s Robbery Homicide Division-Rape Special Section.

During his tenure, he handled several high-profile investigations, including a fatal Christmas night shooting at an Echo Park pizza parlor in 1990, the 1993 stabbing death of a woman and her unborn baby at an automated teller machine in Sherman Oaks, and a 1981 cold-case murder of a newlywed in her Sherman Oaks home by a serial rapist.

DeJarnette moved to the Big Island after his retirement in 2003 from the LAPD.

ENCINO (CBS) — The quest for a luscious set of lashes is leaving some women’s eyelids bare.

More women are using eyelash extensions to enhance their eyes and save time doing their makeup but some say there are downfalls.

“My eyelashes were very average eyelashes. They’re not particularly thick, they’re not overly thin,” Tiffany Howard told CBS2 reporter Sibila Vargas.

The Encino resident had heard rave reviews from friends about eyelash extensions and felt she had to try them.

“So they’re taking glue and they’re gluing on individual eyelashes to your own eyelashes,” Howard said.

She said waking up with bold lashes was worth the money.

“I have no makeup and you can see in this photo that my eyes are popping!”

She also loved the time she saved applying mascara.

But, after a few weeks, the glamor grew out.

“I could feel, when I would blink like that, I could feel the glue,” Howard said. “What I didn’t realize was that the good lashes were coming out with the extensions.”

Howard said she was left with gaps on her eyelids that had no eyelashes and it took months for her natural lashes to grow back.

A beauty insider, who chose not to be identified, said she’s witnessed the same thing.

“Eyelash extensions are the latest addiction. I’ve seen many women that have lost their eyelashes and once they stop using them, they have less eyelashes and I don’t see them coming back,” the insider said.

Dr. Wendy Lee, an eye surgeon, said her patients are mentioning this issue more often.

“The most common complaint I hear is that women end up with shorter stubbier lashes, or either no lashes when they take these off,” Lee said.

“It becomes a vicious cycle because they don’t want to stop the lashes — the lash extensions — in order to grow the lashes back,” the doctor said.

“It’s not the end of the world. They’re eyelashes but it was enough to say I will never do this again,” Howard said.

There are beauticians who say they can preserve natural lashes while providing extensions but Howard said, for now, she has just one tip for beautiful eyes: “Find a fabulous mascara and use it every day!”

FULLERTON (CBS) — The mother of a mentally ill homeless man who died after he was beaten by Fullerton police has reached a settlement with the city that will pay her $1 million.

The settlement agreement unanimously approved Tuesday by the Fullerton City Council resolves Cathy Thomas’ legal claims against the city regarding the death of her son, Kelly Thomas, 37.

His father says any money he receives will be going to the Kelly Thomas Memorial Fund.

His son died in July 2011, five days after his confrontation with Fullerton Police Department officers.

A Superior Court judge last week found there was enough evidence for Officer Manuel Ramos to stand trial for second-degree murder and involuntary manslaughter and Cpl. Jay Cicinelli to face a trial for involuntary manslaughter and excessive force.

The settlement follows that preliminary hearing, during which a 33-minute video and audio recording of the incident was played.

The recordings horrified some people in the gallery immensely who chose to leave the courtroom.

“The blood of Kelly Thomas is on this city,” a member of so-called “Kelly’s Army” said.

The beating sparked outrage in the community and resulted in an effort to recall three council members in next month’s election.

Miley (4-1) yielded eight hits and walked one in 6 2-3 innings, but managed to limit Los Angeles to just one run on Mark Ellis’ homer. The 25-year-old left-hander is 3-1 with a 2.35 ERA in five starts since being inserted into the rotation on April 23 to replace Daniel Hudson, whose right shoulder impingement won’t allow him to return until May 27 at the earliest.

Ellis finished with three hits in the Dodgers’ first game since star center fielder Matt Kemp went on the 15-day disabled list because of a left hamstring strain.

“Steve is more than just a missing person,” his wife, Thea Ivens, wrote in a letter released by Burbank police. “He is a father, a husband, a son, a brother, a nephew, a friend and a colleague in this community.”

The 35-year-old special agent, who works in the FBI’s Los Angeles division, went missing at about 7 a.m. Friday, according to Burbank police. He was last seen at his home in the 1700 block of Scott Road and is believed to have walked to the Verdugo Hills, Sgt. Darin Ryburn said.

Police said Ivens had been despondent and possibly suicidal, and noted a handgun was missing from his home.

His wife wrote: “Steve, if you are out there listening right now, your wife wants to let you know, `Babe, we are in this together for better or for worse. I love you, no matter what happens.’ Your child wants you to know, `Daddy’s work? Daddy home?’

“Your mother wants you to know, `I love you, I need you and come home wherever that home is because I need you back.’ Please remember that we love you, we miss you and let us know that you are OK.”

The family created a Facebook page titled “Let’s Bring Steve Home.”

“We implore the public to help with any information that may lead to bringing Steve back home safely,” his wife wrote. “We ask for your prayers in getting Steve back home safely.”

Ivens is white, 6 feet tall and weighs 160 pounds, with brown eyes and receding brown hair. He wears prescription glasses.

Playing for the sixth time in 11 days, Los Angeles gave San Antonio its toughest first half of the playoffs before fading fast. And unlike their stunning Game 1 comeback at Memphis in the first round, the Clippers didn’t have the wind this time.

Manu Ginobili added 22 points for the Spurs, who’ve won 15 in a row. It’s the longest winning streak sustained in the NBA playoffs since the 2004 Spurs won 17 straight.

“It’s the playoffs. It’s going to be physical. We knew that coming in,” Duncan said. “We just expected to attack the basket as much as possible.”

Eric Bledsoe led the Clippers with 23 points.

Game 2 is Thursday night.

That gives the beat-up and banged-up Clippers one full day of rest — which is all the time they’ve had to recover between games for the past week and a half.

Los Angeles couldn’t even fly home first after knocking out the Grizzlies on Sunday in Game 7 of a grueling series that had the Clippers hobbling next to Texas. Blake Griffin scored 15 points in 28 minutes a day after estimating his sprained left knee had him feeling “80 percent” at best.

The Clippers said the injury is bad enough that their All-Star and leading scorer might be missing up to two weeks if this were the regular season. But unlike in Game 7 on Sunday, Griffin didn’t take a seat in the fourth quarter until the Spurs were safely ahead in the final minutes.

Rookie Kawhi Leonard added 16 points, hitting all three of his 3s, and Danny Green added 15 points for the Spurs.

The marquee matchup of the series — All-Star point guards Tony Parker and Chris Paul — was a fizzle. Paul, who ended the first round with an aching hip, scored just six points and didn’t make a single basket in the second half. Parker had seven points and 11 assists.

Caron Butler scored 15 points and Nick Young had 13 for the Clippers. Los Angeles cut the deficit to single digits with a 10-burst in the fourth quarter before San Antonio, which hasn’t lost in a month, ran away with its 11th double-digit victory during this dominating winning streak.

The Clippers didn’t even need San Antonio’s help getting more bumps and bruises: Mo Williams, already playing with his sore right fingers taped, took a lump on the head when teammate Reggie Evans kicked him with an errant foot after Williams fell on his back in the lane.

Williams wobbled when he tried standing, sat back down, and the Clippers burned a timeout. He never left the game, but the Clippers weren’t getting any fresher.

Parker, meanwhile, finally felt the hard knocks and slow-him-down shoves that Utah repeatedly promised but never delivered in the first round. Sometimes, the All-Star looked in vain to officials when the whistle didn’t blow. When that didn’t work once in the first quarter, he kept jabbering about a no-call on the last possession while lining up to shoot free throws on the current one.

Popovich, pacing and sensing an impending technical foul, silenced his leading scorer.

“Tony!” Popovich snapped from the sideline. “Shoot!”

Parker waved off the NBA Coach of the Year — he was under control. But his frustrations didn’t end there. He was 1 for 9 despite playing 38 minutes, scoring all but two of his points at the foul line.

Notes: Before this became the deepest Spurs team yet under Popovich, Butler said he came so close to signing with the Spurs after the lockout that he canceled a flight to San Antonio when the Clippers counteroffered. “They made a great pitch,” Butler said. …Leonard finished fourth in the Rookie of the Year voting, the highest finish for a Spurs player since Ginobili finished fourth in 2003. Said Popovich: “He’s done a good enough job to make me trust him to be in the starting lineup. I’m happy for him.”

LOS ANGELES (CBS) — Emergency dispatchers in L.A. County take approximately one 911 call every minute of every day. But officials complain that they’re being overwhelmed by unnecessary calls.

According to the L.A. County Fire Department, whose paramedics answer 911 calls, nearly two-thirds of all calls are “bogus”.

During one 911 call a man told an emergency dispatcher that his “mother” was not breathing and wouldn’t get off the floor. Paramedics arrived to find that the man was referring to the motherboard of his laptop computer. That caller was not charged with a crime because he suffered from mental issues.

In fact, there are no laws that make it a crime to dial 911 in a non-emergency situation. Officials say the problem is that many people confuse those situations with emergencies.

“It’s what I would characterize as people with no other options. You know, if you don’t have money and you need health care of some sort, and if you only have one option you use that option — and that’s the 911 system,” said Deputy Chief Mike Metro, of the L.A. County Fire Department. “Unfortunately, we’re obligated, once we show up, we’re obligated to provide only a single portal of medical services, and that’s to put the individual on the back of a very expensive ambulance and to take them to a very expensive emergency room.”

And when the patient insists there’s something wrong the paramedics have no choice but to take them to the hospital.

Some examples at the fire station in Wilmington: There was a case of a baby in distress when all it turned out to be was that the baby wouldn’t stop crying. There was another 911 call where a man was reported unresponsive when he, actually, was passed out from drinking alcohol.

“If you have no insurance you can’t go to a clinic to begin with so what option do you have,” said Metro, explaining that many times people call to get a free ride to an emergency room.

“We need to provide other options,” the fire chief said.

The County would like to set up special clinics at fire houses so that people can get medical attention for non-emergency situations. They said they hope that will divert those calls away from the 911 line.

Los Angeles dominated the opener and was even better in Game 2, withstanding Phoenix’s initial push and string of penalties for a 2-0 series lead.

Dwight King scored his third goal in two games and Quick tied a team record with his third career playoff shutout to give the Kings a dominating lead heading into Game 3 Thursday night in Los Angeles.

The Kings have won nine straight road playoff games in two seasons, matching the NHL record set by the New York Islanders from 1982-83.

The Islanders won the Stanley Cup both of those years.

Quick matched Felix Potvin’s team record for playoff shutouts and Carter finished off his first career playoff hat trick in the third period, securing the Kings’ seventh straight win overall.

The Coyotes played better early and fell apart late, becoming frustrated after being unable to contain the more-skilled Kings.

Phoenix was hit with a string of penalties starting late in the second period, including a game misconduct to captain Shane Doan for boarding Kings center Trevor Lewis. Martin Hanzal also received one for boarding Dustin Brown in the third period and the Coyotes had 13 penalties for 56 minutes — most coming after the final 5 minutes of the second period.

The Kings won the opener 4-2 by outplaying and outhustling Phoenix.

Knowing Phoenix’s makeup, the Kings figured to get more of a pushback in Game 2.

And the Coyotes were much more aggressive early, winning some of the individual battles they lost in Game 1 while creating some decent scoring chances.

Even with all of Phoenix’s hard work and a couple of line changes by coach Dave Tippett, the Kings still managed to score first. King got it, redirecting a shot by Drew Doughty that beat Mike Smith stick side late in the period.

Hard work in the corners by Mike Richards set up Los Angeles’ second goal, by Carter. He muscled the puck past Smith’s glove side as he was going down on a feed from Dustin Penner that made it 2-0 early in the second period.

“I’ve been working hard in practice to get my game where I wanted it,” Carter said.

Then things completely unraveled for the Coyotes.

Doan, who was suspended three games for elbowing earlier in the season, was given a game misconduct and a five-minute boarding penalty for ramming Lewis from behind. Defenseman Keith Yandle was already in the penalty box and Daymond Langkow joined him after a slashing penalty, giving Los Angeles a two-man advantage for more than 2 minutes.

Brown was sent off for diving on a slash by Smith, but that didn’t bother the Kings. Carter scored his second a few seconds later on a redirect of a shot by Anze Kopitar, putting Los Angeles up 3-0.

“It’s no secret we been struggling a bit with the power play and to get some goals will give us confidence on it,” Carter said. “We have some pretty skilled guys out there on the power play.”

With the Coyotes racking up penalties seemingly on every shift, Carter finished them off with his fifth career hat trick, punching in a rebound with the Kings on a two-man advantage after Hanzal’s hit on Brown.

Notes: The Kings were without D Colin Fraser, out of the lineup attending to a family matter. … Coyotes LW Ray Whitney played in his 100th career playoff game. D Michael Stone played his first with Adrian Aucoin still out of the lineup and David Schlemko still not fully healthy. … Rocker Alice Cooper, who lives in the Valley, attended the game. … The last team to win seven straight road playoff games in one season was Chicago in 2010.

Hatcher’s dismissal was announced about 90 minutes after the Angels had 12 hits in a 4-0 victory over Oakland. A day earlier, Los Angeles lost 5-0 to the Athletics — its major league-worst eighth shutout loss already this season.

Los Angeles promoted hitting coach Jim Eppard from Triple-A Salt Lake to replace Hatcher, who had been with the Angels since manager Mike Scioscia — his former Dodgers teammate — took over the club in 2000. A 12-year major league veteran as a player, Hatcher was the Angels’ hitting coach during their only World Series title run in 2002.

“Offensively we have underachieved, and everyone shares in the responsibility of what has transpired thus far,” Angels general manager Jerry Dipoto said.

That’s putting it mildly for a club with one of the majors’ highest payrolls and enormous expectations for this season.

Los Angeles (16-21) has scored just 134 runs, ranking 22nd in the majors while setting a club record for shutout losses at this point in the season. The Angels’ on-base percentage is .301, worse than all but three teams.

Although Hatcher’s job description probably didn’t include fixing Pujols, the $240 first baseman is having trouble in his first six weeks with the Angels, batting .212 with just one homer. The three-time NL MVP boosted his average 15 points Tuesday with three infield singles, driving in two runs.

Hatcher also angered Pujols a few weeks ago when he shared a few innocuous details about a team meeting with reporters. Pujols said he planned to talk to Hatcher about keeping clubhouse discussions private, although neither man commented about what happened after that.

Just three seasons ago, Hatcher presided over a roster that set several franchise records for hitting and fielded a lineup with nine .300 hitters while the Angels reached the ALCS. These days, few Angels are having offensive seasons that aren’t embarrassing.

Shortstop Erick Aybar, who got a $35 million contract last month, is batting .187, and outfielder Peter Bourjos has been benched after his .193 start. New catcher Chris Iannetta slumped to .197 before going on the disabled list, and Bobby Abreu was batting just .208 before Los Angeles released him.

High-priced outfielder Vernon Wells is in his second straight middling season, batting .242 with five homers. Howie Kendrick, an All-Star last season, is batting just .273.

Eppard worked with Bourjos, Mark Trumbo and Mike Trout in the minors while spending the last 10 years at Salt Lake. He played four years in the majors for the Angels and Toronto.

Scioscia said nothing about Hatcher’s departure Tuesday after the Angels’ win over Oakland.

“We think the absolute world of Mickey as a person and thank him for all of his contributions to this organization,” Dipoto said.

Mike Trout went 3 for 4 with a homer and three runs scored for the Angels, who finally produced enough offense to back a strong performance by Santana (2-6). The Dominican right-hander retired 16 in a row early, winning his second straight start after a rocky beginning to the season.

Bartolo Colon (3-4) allowed 12 hits while pitching into the seventh inning for the A’s, who were off to an AL-best 8-4 start in May.

Obama welcomed Beckham and the Los Angeles Galaxy to the White House Tuesday to celebrate their third Major League Soccer Cup. The president joked that the star-studded Galaxy, led by Beckham, midfielder Landon Donovan and forward Robbie Keane, are the “Miami Heat of soccer.”

Obama told the 37-year-old Beckham that half of his teammates “could be his kids. We’re getting old, David.” The president said the model and athlete was “holding up better than me.”

Beckham generated attention in February when H&M aired ads for his new undergarment collection during the Super Bowl.
