The boy has been identified as Xavier Minniefield. He has been charged with several counts including involuntary manslaughter, possession of a firearm and assault with a semiautomatic weapon.

Minnifield's mother told Cruz it was all just a terrible accident.

The uspect's mom says she feels guilty -- that she should've done more as a mom.

""My son should've had more supervision," she said.

Minnifield said her son didn't own the gun.

"It didn't belong to him. He didn't know it was real. He didn't know it was loaded. He thought it was a BB gun," she said.

On Sunday, Minniefield says her son and a group of teens were making a music video at Washington's home, using BB guns as props.

Amber says her son told her he unknowingly picked up a real gun that he found inside the home.

"He didn't know the difference," she said, "I wish the person that owns the gun would come forward."

Authorities haven't said if the gun is registered but did confirm on Monday the shooting was an accident.

"He feels horrible," said Amber. "I've apologized to the family many times. They just want to keep pointing the finger. I'm sorry about their loss."

Meanwhile, Dakota's sister (who didn't want to appear on camera) told Cruz she's not buying that the shooting was an accident, And she says there weren't any real guns at her home.
