New Trial Likely For Man Convicted In SWAT Officer's Death

FONTANA (AP) — A Fontana judge has tentatively said prosecutors can proceed with a second trial against a man convicted in the 2007 deadly shooting of a Rialto SWAT officer.

San Bernardino Superior Court Judge Steven Mapes tentatively ruled Monday that a new trial could move forward against 35-year-old Krist Antonio Wiggins, who last month was found guilty of involuntary manslaughter in the death of SWAT officer Sergio Carrera Jr.

The 29-year-old Carrera was shot and killed in October 2007 as the officer served a search warrant during a narcotics raid at Wiggins' Rialto apartment.

The jury could not reach a unanimous verdict on a special enhancement that alleged Wiggins personally and intentionally fired a gun.

Wiggins is due back in court Jan. 7.
