Appeals Court To Hear Arguments In OC Woman’s Custody Fight

SANTA ANA (AP) — A California appeals court will hear arguments in the custody fight of a California woman who’s trying to adopt a toddler over the objections of her biological father in Ohio.

City News Service reports justices will hear arguments Tuesday on a motion to stay a ruling that gave jurisdiction over custody of a 2-year-old girl named Vanessa to Ohio courts until a full appellate court panel can decide which state has jurisdiction.

Vanessa has remained with Stacey Doss — the would-be adoptive mother from Orange County — because of an earlier ruling blocking her return to her father.

The father — Benjamin Mills Jr., of Dayton — filed for custody in Ohio in 2008 before the adoption was finalized. A separate custody battle is continuing in Ohio.

    As a mother of a toddler of a similar age, I urge the courts to keep this child with her adoptive mother. Perhaps only a parent, and a mother in particular can understand that this child only knows her adoptive mother as her true parent, and the trauma that would result in her being placed with her biologial family would destroy this poor child. I understand rights, but sometimes even as a biological family, you have to realize and do the right thing for the child. The father must know the damage this would do, and the fact that he has a criminal history and isn’t qualified to raise the child should be more meaningful. Please allow this child to continue to be raised in her loving home, with her responsible and loving mother in a safe and secure environment.

    I couldn’t agree more with you, Caroline. The emotional consequences would be devastating… Not to mention that, by placing this child with her biological father, she is directly in harms way. This biological father is a convicted felon. He is violent and dangerous; he has served prison time for brutally beating Vanessa’s biological mother; he has an open child endagerment case pending in court; he has 4 other children that he doesn’t have custody of; he has a record of charges related to illegal drug use; he has 6 ‘warrant blocks’ on his driversa license, 4 of which are for non payment of child support,; and on and on and on… Too many times have we heard the stories of a childing dying at the hands of a court order. Let us pray that the courts do the right thing.
