Zsa Zsa Gabor's Daughter To Ask For Court Conservator To Oversee Her Mother's Affairs

LOS ANGELES (CBS) — Zsa Zsa Gabor's daughter, who is locked in a bitter dispute with the husband of the ailing 95-year-old actress, plans to ask a court Tuesday to appoint a conservator to oversee her mother's affairs and ensure she is not being exploited.

The move was prompted by Constance Gabor Hilton's discovery that her mother's home is in default over missed mortgage payments and that Gabor's husband, Frederick Von Anhalt, 68, recently secured a $700,000 loan against Gabor's equity in the property, according to a statement issued on behalf of Hilton's attorney.

"These two recent discoveries have forced Ms. Hilton to ask for Court supervision over her mother's well-being in a Petition for Conservatorship in Los Angeles Superior Court," the statement said.

There was no immediate comment from Von Anhalt

The Petition for Conservatorship was being submitted in Los Angeles Superior Court Tuesday, according to a statement by a spokesman for Attorney Kenneth W. Kossoff. It will give the court a vehicle by which "to investigate Zsa Zsa's health, assets and total environment and decide what is in her best interests," it said.

Hilton, the statement said, wants "to have a court decide what is best for her mother, to determine whether Zsa Zsa is getting the best care she can afford, whether Zsa Zsa is being isolated or allowed to be with family and friends who love her, and whether her funds are being managed in her best interests."

Gabor's right leg was amputated a year ago because of gangrene. After she broke her hip in July 2011, the Hilton-Von Anhalt relationship appeared to deteriorate.

Kossoff, Hilton's attorney, said that "in spite of her conflicts with von Anhalt, Francesca has been hoping he had Zsa Zsa's interests at heart.

"However, having just recently learned that he took out a $700,000 loan, and that there was a notice of default recorded against the property in late February 2012 because he apparently has not been paying Zsa Zsa's mortgage payment, it became clear to Francesca that if she did not seek to protect her mother, no one else would."

He said Hilton has been waiting patiently for over a year to receive medical evaluations about her mother and financial documents from Von Anhalt showing he is capable of caring for Gabor, but he has refused to comply.
