LOS ANGELES (CBS) — Will a statewide ban aimed at California gun owners backfire on lawmakers?

KNX 1070’s Pete Demetriou reports a legal challenge to concealed handgun carry laws may soon be in the works.

Gun rights advocates are considering filing a lawsuit over new state laws that went into effect in January that prohibit owners from openly carrying even unloaded handguns.

The potential lawsuit would contend that California’s concealed handgun laws vary so much between county jurisdictions that they are discriminatory and unjustified.

Some citizens argue that, with certain limitations, an adult with no criminal or mental health record should be allowed to carry a concealed firearm — especially in certain parts of the city.

“In LA with the hate crimes, with the gang-banging going on, everybody is subject to be victimized nowadays,” said one man.

Assemblyman Anthony Portantino, who authored AB144 that was signed into law by Gov. Jerry Brown back in October of last year, told the Los Angeles Times that the law was “a reasonable move to close a loophole” and expects AB144 to survive legal scrutiny.

Gun rights advocates, however, are expected to wait for the most effective case to possibly take all the way to the Supreme Court as a variety of legal cases continue to work their way through the appeals process.

    I find it interesting that the Obama administration will challenge state laws on illegal immigrants yet when a state makes a law curtailing constitutional rights like the second amendment they don’t say squat. I still don’t see how a state can enact laws that are against the constitution. It reads, “keep and bear arms”. What is ambiguous about that?

    1. Larry, that’s what executive orders are for. A convenient work around for any sitting POTUS.

    The criminals have guns, why cant the citizens carry one for their protection and others? Criminals WILL ALWAYS be able to find guns to buy NO MATTER what law gets passed. So again, the criminals win and the citizens lose! Heres an idea, why doesn’t the Federal Government and our “police states” quit trying to enforce laws on law abiding citizens and send their resources to the border where every illegal activity under the sun happens all day long 24 hours a day!!!!!! We have become potential victims for any criminal because of the laws and regulations passed by idiot law makers!!!!!

      Yea but if everyone was carrying….then situations like the fight that happened at Disney would end up a way worse situation than what happened.

        Everyone wouldn’t be carrying. In all the other states it’s around 4-5%. You don’t hear about CCW carriers going nuts and gunning down anyone at Six Flags do you. If 5% of ducks shot back, how many people would still duck hunt hmm?

        That isn’t necessairly true. There are many places that you are still not allowed to have a weapon on you, even if you have a permit. Theme parks, sports venues are just part of a long list. The concequences are compounded if you do.

    this law can’t stand scrutiny outside liberal-fascist california. It’s a straight up ban, which makes it a clear cut 2nd ammendcment violation. I always thought those open carry people with their unloaded guns were stupid, but what they enacted into law just won’t survive any dedicated legal challenge. In fact, it more than likely will open up a bigger can o0f worms because many of California’s gun laws are hiughly questionable. Sonds about right for our legislators though. try and hit a fly with a sledge hammer and you are probably gonna miss the fly and end up breaking something else. They’ll never learn.
