LOS ANGELES (CBS) — The Los Angeles City Council approved a new law Tuesday that will require adult film stars to use condoms.

The council tentatively approved the ordinance, which will require all performers in adult videos to use condoms, last week.

Ordinance supporters say the measure is needed to prevent the spread of HIV, but the adult video industry’s trade association, the Free Speech Coalition, says condoms are not necessary.

Los Angeles is the first city in the nation to approve a law requiring actors to use protection during sexual intercourse.

    The pornography industry is larger than the revenues of the top technology companies combined: Microsoft, Google, Amazon, eBay, Yahoo!, Apple, Netflix and EarthLink.
    The US spends $13 billion a year on porn – the world spends $100 billion a year.
    They don’t need to operate in California.
    If California doesn’t want that business one way to get rid of it is to over-regulate to the point of creating disincentives.

    The issue of the L.A. city council requiring condom use in adult entertainment is not about the safety of the performers, the producers use STD battery tests to insure that, the issue is the censorship of the images that the industry produces. The AIDS Healthcare Foundation wants to promote safe sex practices and censoring what they deem as unsafe sex from visual media is part of that effort.
    The reality is that because of the industries rigorous testing procedures, it really is safe sex. It’s safer even than a monogamous relationship actually, because every performer is tested before preforming whereas a spouse might be cheating on you without your knowledge and never get tested.
    Furthermore I would go on to point out that the likelihood of infection (with a proper testing regime) is relatively low, you wouldn’t ban stunts from movies because one or two stuntmen were injured over the course of a few years would you? Did anyone propose banning guns from movies when Brandon Lee got accidentally shot?
    Yet despite the fact that HIV is even now treatable and not fatal (indeed, those infected have to take medication and are limited in their reproduction, it is little more than a minor disability), you propose that the rare possibility of an accident is cause to impose visual censorship on the entire industry?
    This entire issue has been trumped up by AIDS Healthcare Foundation, a lobby group who’s seeing the waning of the significance of their cause and is therefore drumming up publicity in the hopes of spurring corporate and private donation so that they can prolong their proverbial gravy train. Why else would they choose to trumpet the issue now, after HIV has been treatable and manageable for years? Clearly this is an issue of this group seeking donations and exploiting the corruption of the L.A. city council to drum up publicity.
    This is nothing more or less than an attempt to censor visual media in the movie capital of the world. If they censor adult entertainment in the name of “public health” today, why not censor violence in movies tomorrow, or how about ideas that aren’t conducive to the public wellbeing such as certain lyrics in rap music? If one special interest group can censor one form of creative expression, why not others?
    This is a direct assault on free speech and free expression, nothing more and nothing less and it is not the end. You don’t take away people’s rights with one stroke or there’ll be public outcry, you do it incrementally in little baby steps and that’s what this is, a step toward censorship.
    If they want their industry to survive the porn producers should found a superPAC right now and start fighting for the recall of every city council member who voted for this ban, and anyone who supports freedom of artistic expression should support them.

First Amendment ain’t gonna help either — this is the commercial sex industry, it is highly regulated. This is not the non-commercial sex you have with you partner for non-meritricious motives.

    Issue: Do municipalities (i.e., States) have the power to enforce a regulation requiring porn star condom use in the commercial sex industry?

    Rule: Under the 10th Amendment to the Constitution, States can make laws that deal with the health, safety, welfare, and morals of its citizens. If a regulation or policy is rationally-related to the health,

    Brief Analysis: Consenting adults have a right to have consentual sex with other adults. The government has no business forcing people to wear condoms when they have sex. After all, you have a right to express yourself through sex, no? This is probably true, but as it relates to the provision requiring condom use in the porn industry, the argument will fail because it has nothing to do with your choice to have sex but the MANNER in with you have sex.

    Moreover, although most of you would assert that the government has no right to force you to wear condoms in your bedroom, this is not the case before us, as it pertains to the adult porn industry, which by definition is an exchange of services services (i.e.,entertainment) for financial gain.

    States and municipalities have the right to regulate the commercial sex industry (i.e., porn industry or porn filming) because it is rationally related to a legitimate governmental interest. Protecting the health and safety of the porn star artists and gaurding against rampant spread of hiv commonly and frequently obtained by actors and actresses who fail to use condoms, is a legitimate governmental interest buddy.

    Conclusion: The County of Los Angeles (i.e., governmental actor) can require condom use for those performing sex acts, during the filming of adult porn.

    Who wears the condom, the man or the woman? Possible 14th Amendment concern. Gender discrimination?
