LOS ANGELES (CBS) — A federal civil rights lawsuit has been filed on behalf of the family of a Guatemalan day laborer who was shot and killed by Los Angeles Police Dept. officers in September.

Attorneys for Luis Carrillo and Dale Gallipo say they have eyewitness testimony that contradicts the LAPD's version of the shooting of Manuel Jaminez Chum, whom police said was armed with a knife.

Carrillo and Gallipo say Chum did not pose a threat to officers or anyone at that time he was shot.

The LAPD's official investigation into the shooting may take another six months to complete — and any potential trial may not take place until early 2012.
