Judge Refuses To Reconsider Decision On Execution

SAN FRANCISCO (AP) — A federal judge has refused to reconsider a decision that paved the way for California's first execution in nearly five years.

Death row inmate Albert Greenwood Brown told the judge that he doesn't have enough information about California's lethal injection process to choose his method of execution.

U.S. District Court Judge Jeremy Fogel on Friday refused to block Brown's execution.

In doing so, the judge gave Brown a choice of death between a one-drug injection and a three-drug cocktail, which is how prison officials executed inmates in the past.

Fogel said he would call off the execution if Brown chose a one-drug method and the state insisted on executing him with the three-drug cocktail.

On Saturday Fogel refused the inmate's request to reconsider his decision.

Brown's execution is scheduled for Wednesday.
