Anna Nicole Judge Cites Flaws In Prosecution Case
LOS ANGELES (AP) — The judge overseeing the drug conspiracy trial of Anna Nicole Smith's two doctors and lawyer-boyfriend says he thinks part of the prosecution's case conflicts with state law.
Los Angeles Superior Court Judge Robert Perry told prosecutors Thursday that he has been researching the statutes used to charge the trio with illegally prescribing prescription drugs to an addict and other allegations.
The judge says he thought state lawmakers made clear they did not want prosecutors to charge doctors trying to treat patients with legitimate pain issues.
Perry says the lawmakers' statement should be considered by the jury and be part of a defense motion to dismiss charges in the case.
