Playmate Could Face Charges In Body Shaming Case

LOS ANGELES (CBSLA.com) — A Playboy Playmate's Snapchat photo may land her in both criminal and civil courts.

Dani Mathers admitted to posting a naked picture of an older woman in a gym locker room.

Mathers has been publicly criticized for posting a photograph on Snapchat which shows a naked women who appears to be her 70s inside a woman's locker room.

Mathers wrote the following caption in the post: "If  I can't unsee this, then you can't either." She has since apologized for the so-called public shaming.

The Los Angeles Police Department confirms an investigation is underway. TMZ reported police have tracked down the woman in the photo and that she wants Mathers prosecuted to the fullest extent of the law.

"If it can be proven that the person is identified and has a reasonable expectation of privacy then certainly there is a criminal case here," criminal defense attorney Lou Shapiro said.

Shapiro, who is not representing either party in the case, says Mathers faces a misdemeanor, which carries a maximum sentence of six months in the county jail.

"Generally on a first time misdemeanor, someone is not going into custody but because of the behavior in this situation, it's aggravating and a judge may seek custody time," Shapiro said.

Shapiro says the former Playmate of the Year could also be slapped with a civil lawsuit if the woman in the photo decides to go that route.

"She definitely has a case," Shapiro said. "And given the embarrassment factor and all of the people aware of it, I think this is a case that could settle very quickly."

Mather's attorney Tom Mesereau offered the following statement: "Dani Mathers never tried to hurt anyone at anytime and certainly never tried to break the law."
