Family Of 14-Year-Old Boy Fatally Struck By Tow Truck In Ventura Files Suit

VENTURA (CBSLA.com) — The family of a teenager killed in a collision with a tow truck has filed a lawsuit against the driver, as well as the city and county of Ventura.

"All we want is justice for Jonathan," said Joanna Hernandez, who fought back tears as she talked about the death of her 14-year-old son.

Jonathan was riding his bike at Telegraph Road and Saticoy Avenue on Feb. 18 when he was hit by a tow truck and a second vehicle. Both allegedly fled the scene.

CBS2 attempted to speak with Martin Henderson -- the man accused of driving the tow truck -- at his business Wednesday but was told he was not there.

"It was only after Henderson learned that cameras had captured him and his truck hitting Jonathan that he decided to contact the police," said Sean Andrade, an attorney for the Hernandez family.

Henderson has not been charged and now the family has filed a civil case against him, the city and the county of Ventura.

Andrade says both had contracts with Henderson and knew he shouldn't be driving a tow truck. The city and county said they could not comment on pending litigation.

Meanwhile, the District Attorney's office said it is still reviewing the case against Henderson and there is no information on that second driver. The family hopes someone will come forward.
