Former USC Student Sues 3 Members Of School's Baseball Team Over Release Of Sex Tape

LOS ANGELES (CBSLA.com)  —  Three one-time members of the USC baseball team are being sued for invasion of privacy and emotional distress after the release of a tape of a former student having sex with one player.

The woman, identified in a Los Angeles Superior Court complaint as Jenna Doe, is seeking unspecified compensatory and punitive damages on allegations of negligence, intentional infliction of emotional distress and invasion of privacy.

The suit names former outfielder Vahn Bozoian and pitchers Marc Huberman and Sean Adler.

Representatives for the defendants could not be immediately reached.

The suit states that Doe was a star softball player in high school and a "passionate fan of the game of baseball." She and Bozoian met in February 2012 and later began a relationship that included consensual sex, the suit says.

However, in March 2013, the suit alleges, the three players secretly taped Doe and Bozoian having sex.

The trio later distributed the video "to the general public including ... other members of the baseball team," according to the lawsuit.

The lawsuit alleged that Bozoian urged Adler to hide in the closet and record he and Doe having sex, using his cellphone.

The woman says she found out about the video in December 2013 when one of her sorority sisters said she had "some terrible news" and recounted to the plaintiff that a member of the baseball team told her about the video and its wide distribution.

"Plaintiff was immediately embarrassed, disgusted, humiliated and distraught," the suit states.

The woman says she sought counseling that night and postponed her final exams because she was unable to focus. She was "taunted and harassed" on campus the next semester by other students who saw the video. Doe says she withdrew from several classes and postponed exams because of her distress, according to court papers.

The lawsuit also said she had to seek psychiatric treatment.

College Baseball Daily reported in May 2014 that the power-hitting Bozoian, who is 6-foot-5 and weighs 210 pounds, was dismissed from USC for an unspecified disciplinary issue.

CBS2's Dave Lopez spoke to Bozoian's father Friday but he had no comment.

Huberman is still on the team. Lopez reported the school was playing in an NCAA playoff game in Lake Elsinore Friday.

Said fan Fred Blaskovich, "If the players want to act that way, then the punishment that comes their way is justified, that's how I feel."

The school is not being sued. School administration has not made a comment about the lawsuit.

Lopez reported that Doe is asking for a jury trial.
