Attorneys For Halle Berry, Gabriel Aubry Head To Court

LOS ANGELES (CBSLA.com) — Lawyers for Halle Berry and her ex-boyfriend, Gabriel Aubry, attended a hearing in family court Tuesday morning.

The actress' attorney reportedly tried to extend a judge's order that says Aubrey must stay at least 100 yards away from Berry, their 4-year-old daughter, Nahla, and Berry's fiancé, Olivier Martinez.

The emergency order, which is set to expire Tuesday, was issued after a brawl between Martinez and Aubry on Thanksgiving Day. However, neither lawyer would speak to the media, so it's unclear if it was extended, according to KCAL9's Amber Lee.

TMZ reports Aubrey, who was dropping Nahla off following a custodial visit, suffered fractured ribs and a bruised face, while Martinez injured his hand and neck.

Both men were taken to Cedars-Sinai Medical Center, but Aubry was later arrested and booked on a misdemeanor battery charge.

He was released after posting $20,000 bail.

Aubry's lawyers claim 46-year-old Martinez instigated the fight and even threatened to kill the 37-year-old model before slamming his head on concrete.

Aubry filed a restraining order against Martinez on Monday and is expected to be in court to oppose Berry's request.

A judge is expected to decide whether to extend Aubry's restraining order against Martinez on Dec. 17.
