Intruder Shot, Killed After Breaking Into Dana Point Home

DANA POINT (CBS) — Orange County sheriff's deputies Tuesday were investigating the fatal shooting of a man who apparently broke into a Dana Point home.

The man, whose name was withheld pending notification of relatives, got into a home in the 34000 block of Capistrano By the Sea in Dana Point about 10:45 p.m. Monday, according to Jim Amormino of the Orange County Sheriff's Department.

The homeowner, who was roused by the noise of the break-in, got his gun, confronted the intruder and shot him, Amormino said.

The intruder managed to climb back out a window, but died a short time later just outside the house, Amormino said.

Investigators have not yet determined whether the shooting was justified, Amormino said. The Orange County District Attorney's Office will investigate, which is routine in such shootings, Amormino said.
