Mom, Stepfather Face Murder Charges In Death Of Banning Boy, 2

BANNING (CBS) — The mother and stepfather of a 2-year-old Banning boy are behind bars Saturday and could face homicide charges after the child was declared brain dead.

Andrew Lee Payne, 24, and Davia Damanique James, 22, were arrested Thursday, according to Banning police Sgt. Alex Diaz.

Payne was booked into county jail on suspicion of felony child cruelty, and bail was set at $20,000, according to jail booking records. James was booked on suspicion of child negligence, with bail set at $5,000, police said.

Authorities were summoned about 4:15 a.m. Wednesday, two days after the boy suffered an unspecified injury. He was taken to San Gorgonio Memorial Hospital, transferred to Loma Linda Children's Hospital and declared brain dead about 7:30 last night.
