OC Teen Sentenced To 40 Years To Life For Gang Killing Over Stare

SANTA ANA (AP) — A teenage bicyclist convicted of killing a rival gang member in Santa Ana because he resented the way he looked at him has been sentenced to 40 years to life in prison.

Orange County prosecutors say 15-year-old Andrew Cervantes, who was tried as an adult, received the maximum term Friday.

Cervantes was convicted of second-degree murder and street terrorism with gang sentencing enhancements on Sept. 8 for the killing of 17-year-old Manuel Orozco.

Prosecutors say Cervantes was riding his bike when Orozco gave him a hard stare perceived as disrespect.

Cervantes' attorney Ken Morrison argued it was self-defense because Orozco reached for his waistband. He was unarmed.

A co-defendant, 15-year-old Jose Moreno, pleaded guilty to being an accessory after the fact and received three years in juvenile hall.
