Family Files Lawsuit Against MTA Over Deadly Stabbing

LOS ANGELES (CBS) — A lawsuit has been filed against the MTA in connection with a deadly stabbing.

The family of the victim claims the Metropolitan Transit Authority did not have proper security when Jesse Garay, 59, was killed during a confrontation last month at the Hollywood Red Line station.

The lawsuit was filed Friday morning. Janie Garay, Jesse’s mother, is seeking damages for funeral and burial expenses, pain and suffering and loss of companionship.

Police later arrested a transient, 33-year-old Gene Sim, in connection with the crime. No charges have been filed and Sim is being held on a parole violation.

The deadly incident was the first on the subway, since it opened in 1993.

The MTA has no comment on the lawsuit.

There you go! Heaven forbid the family actually seek justice via the criminal courts and support the criminal charges and maybe even the death penalty against the actual killer. NO!!! We have to sue the folks who owned the ground the death happened on since they can spend taxpayer money. WooHoo! Lottery win for us in our time of sorrow!

kelly sad but true if you are in a public place like as you say a park minding your own business and someone kills you as you said in a gang fight you would be allowed to sue who ever owns the park be it the city,state,fed or even a pvt person and YOU WOULD WIN. i agree its crazy to sue over a case such as this what will money do for them??

The Big Logic

Those who are naive enough to put themselves into the presence of danger w/o personal protection, deserves whatever it is they encounter. Riding public transportation in the urban areas of America is doing just that, and should not be rewarded for stupidity. Many of those who ride public transport, are ghetto savages with violence in their bloodline, and will not hesitate to take advantage of those who appear weak. But then, aren’t we ALL aware of that by now?

I pity anyone who has to use any of the Metro lines. They attract a horribly inconsiderate group as customers and the lines are under policed. Many ride for free because of lax enforcement from the Sheriff’s Dept. You can go days without seeing any deputies actually riding the train.
