Family To Sue Schwarzenegger For Nunez Sentence Reduction

SAN DIEGO (CBS) — The family of a boy stabbed to death at San Diego State will sue Arnold Schwarzenegger over a sentence reduction for the son of former Speaker Fabian Nuñez.

Attorneys for the family of Luis Dos Santos, a student stabbed to death in San Diego in 2008, say the former governor violated their constitutional rights under "Marsy's Law," a voter-approved 2008 measure that requires notification of parole hearings in advance for victims of crimes, including family members.

Esteban Nuñez pleaded guilty to voluntary manslaughter for Santos' killing and assault with a deadly weapon in connection with his attack on another man.

On his last day in office, Schwarzenegger used his executive powers to trim Nuñez's sentence by over half from 16 years down to seven years.
