Judge Dismisses Conviction Of Howard K. Stern

LOS ANGELES (AP) — A prosecutor has denounced a ruling dismissing the drug conspiracy convictions against the late Anna Nicole Smith’s former boyfriend Howard K. Stern and her psychiatrist and says he will appeal.

District Attorney Steve Cooley says the decision Thursday by Superior Court Judge Robert Perry diminishes the huge social problem of prescription drug abuse facilitated by unscrupulous medical professionals.

Cooley also says the ruling denigrates investigative efforts by the state Department of Justice and the state Medical Board.

The judge allowed only one conviction to stand against psychiatrist Khristine Eroshevich for obtaining a Vicodin prescription under a false name. However, the charge was reduced to a misdemeanor and she was sentenced to probation and a $100 fine.

I guess the jury got it wrong…

Was the judge laughing when he did this?

Exactly why I refuse to waste my time sitting on a jury.

  • geeM

How could a judge justify this ? Where did they get this guy ?

  • notlovinLA

    Right on, judge! Excellent call!

  • wobbles

So I guess the judge got his bribery money on time. What’s the point in having a jury system if a judge can just do whatever they feel like?

  • Pamela Cooper

Judge Perry thinks he is in charge of everything and everyone in life. He convicted my son of first degree murder. It will be overturned with the Supreme Court. Finally, the public will see how corrupt Judge Perry is!

  • Ret. Sgt. Col. Lt. PFC Smith III, Sr.

How did the judge, and not a jury, convict your son of a capital crime?

  • wobbles

I’m guessing a JURY convicted your little precious of 1st degree murder.Or am I wrong? Sour grapes because he didn’t set aside his conviction too?

  • Lee Cole

The Judge got it right. He may be an ass, or incompetent, but not in this case.
This case was purely political. Cooley when he was running for Attorney General brought the prosecution when no one else in U.S. was touching this issue. He just wanted headlines. And he spent at least a couple million of our tax dollars getting one little misdemeanor conviction and a $100 fine.
The message the judge was seding wat ot Cooley, dont waste Court and Jury time with these non cases.
The same thing is going to happen in the Michael Jackson doctor case. This was a Jerry Brown fiasco, only brought while he was running for Governor and still Attorney General. A 4 week preliminary hearing just to determine if there is a case costing us millions of tax payer dollars for a maximum conviction potential for the doctor of 5 years in prison. Its all political b.s.
